Use of the True Wave Marketing Platform/True Wave Marketing Services
Important Note: For the purposes of these terms and conditions, "TWM" shall refer to True Wave Marketing.
Please read the following terms and conditions carefully before registering on, accessing, browsing, downloading, or using the True Wave Marketing website located at www.truewave.club, and all associated sites linked to www.truewave.club, or the True Wave Marketing application or any similar platform (hereinafter collectively referred to as the TWM Platform). All services offered by True Wave Marketing (hereinafter referred to as TWM Services) are subject to the following terms and conditions.
Acceptance
By registering on, accessing, browsing, downloading, or using the TWM Platform for any general purpose or for the specific purpose of availing any TWM Services, you agree to be bound by these terms and conditions (hereinafter referred to as T&Cs).
- These T&Cs also include any additional or modified terms and conditions applicable to any specific service offered by TWM.
- By registering on, accessing, or using the TWM Platform or availing of any TWM Service, you automatically agree to all the T&Cs.
- If you do not agree to any of the T&Cs, you must immediately terminate your use of the TWM Platform.
Accepting these terms constitutes a legal contract (hereinafter referred to as the Agreement) between you, as a user, and True Wave Marketing, a company dedicated to empowering financial freedom and success.
As long as you comply with these T&Cs, TWM grants you a personal, non-exclusive, non-transferable, limited, and revocable privilege to access and use the TWM Platform and avail of its services.
Eligibility
- The TWM Services are only available to individuals who are at least 18 years of age.
- By accepting the T&Cs, you confirm that you meet the age requirement and have not been previously suspended or removed from using the TWM Platform.
- You also represent that you have the right, authority, and capacity to enter into this Agreement and abide by all T&Cs.
- Impersonating any person, misrepresenting your identity or affiliation, or violating the T&Cs may result in suspension or permanent termination of your access to the TWM Platform and services.
Services Offered by TWM
True Wave Marketing provides a variety of services, including but not limited to:
- Multi-product marketing and business platform services.
- Membership programs such as the Success Wave Community Plan.
- Real estate opportunities, luxury travel packages, and premium product purchases.
By availing of these services, you agree to adhere to the specific terms related to each service, as outlined by TWM.
Other Terms and Conditions
- Booking Responsibility: As part of travel bookings, True Wave Marketing is not responsible for providing fare facilities for transportation to the destination. Customers must arrange their own transportation to hotels or resorts.
- Service Modifications: True Wave Marketing may modify, discontinue, or update any service or feature of the TWM Platform without prior notice.
- Additional Terms: Certain services, such as promotions or contests, may have additional terms and conditions that will be communicated separately. In case of any conflict between these T&Cs and additional terms for specific services, the latter will take precedence.
- Information Updates: Materials and service details on the TWM Platform may be subject to updates. TWM is not obligated to ensure all materials are current at all times.
IBO Service and Participating Platforms – True Wave Marketing
True Wave Marketing’s Independent Business Owner (IBO) Service offers you the convenience of accessing and managing your business on all platforms operated by True Wave Marketing (TWM) or its affiliates (hereinafter referred to as the Participating Platforms) with a single log-in system.
After completing a one-time registration, users can log in to all TWM Participating Platforms using their IBO credentials. Furthermore, if a user is already logged in to one Participating Platform, they can seamlessly access all other Participating Platforms without additional log-in procedures (subject to specific declarations required by each platform).
Features of the IBO Service
- Single Registration and Log-In:
- A one-time registration provides access to all TWM Participating Platforms with the same log-in credentials.
- Users can easily navigate across platforms without repeated log-ins.
- Access Across Platforms:
- Platforms offering the IBO service as a login feature will be visible during registration and in the user account.
- The number of Participating Platforms may change over time.
- Independent Terms and Conditions:
- Each Participating Platform may have its own business and user terms and conditions in addition to these T&Cs.
- The affiliate operating each platform is solely responsible for the respective platform's content and features.
User Registration Requirements
To use True Wave Marketing’s IBO Service, users must meet the following requirements:
- Eligibility: Only users who meet the eligibility criteria outlined in the T&Cs are allowed to register.
- Single Account: Each user is permitted to create only one account.
- Accurate Information: Users must provide accurate, complete, and truthful information during registration and for the duration of the service.
- Confidentiality:
- Login credentials are strictly personal and must not be shared with third parties.
- Users must immediately notify TWM of any unauthorized use, misuse, or suspected breach of their account credentials.
- Users are prohibited from using another person’s user account.
IBO Agreement
The submission of a completed registration form by the user constitutes an invitation for True Wave Marketing to make an offer to enter into an agreement for using the IBO Service (hereinafter referred to as the IBO Agreement).
Steps to Finalize the IBO Agreement:
- Confirmation Email:
- Once registered, users will receive a confirmation email containing a link, along with their username and password for the IBO Service.
- By clicking the confirmation link, the user accepts the offer, and the IBO Agreement becomes effective.
- Other Communication Modes:
- The conclusion of the IBO Agreement may also occur via other communication modes, as determined by TWM to achieve the same purpose.
Right to Reject:
- True Wave Marketing reserves the right to reject individual users without providing specific reasons.
User Obligations
- Data Accuracy:
- Users must ensure that all data provided during registration and subsequent updates are complete, accurate, and truthful.
- Any changes to user data must be promptly updated in their account.
- Account Security:
- Users are responsible for maintaining the confidentiality of their log-in credentials.
- Unauthorized access or suspected misuse of the account must be reported to True Wave Marketing immediately.
- Prohibited Actions:
- Sharing login details with third parties.
- Using another user’s account for any purpose.
Participating Platforms and True Wave Marketing Rights
- The TWM IBO Service is owned and operated exclusively by True Wave Marketing for use on all Participating Platforms.
- True Wave Marketing reserves the right to modify or update the number and features of Participating Platforms over time.
Communication Policy – True Wave Marketing
By accepting the Terms and Conditions (T&Cs), you agree to the following Communication Policy regarding notifications, alerts, and updates sent by True Wave Marketing (TWM):
1. Alerts and Notifications
True Wave Marketing may send alerts and updates to the following:
- The mobile phone number provided by you during registration or any updated mobile number you later provide.
- Your registered email address.
- Via push notifications if you have enabled this feature.
Delivery Conditions:
- SMS alerts will only be received if your mobile phone is in ‘On’ mode and capable of receiving messages.
- Email alerts will be received only if your email servers and email IDs are functional.
- Push notifications will only be received if your device supports them and the feature is enabled.
If your mobile phone is in ‘Off’ mode, your email server is not functional, or the push-notification feature is turned off, TWM is not responsible for missed or delayed alerts.
2. Delivery Efforts and Responsibility
- True Wave Marketing will make the best efforts to provide timely and accurate alerts via SMS, email, or push notifications.
- It shall be deemed that you have received the information sent by TWM to your registered mobile number or email address.
- TWM is under no obligation to confirm the authenticity of the recipient of the alerts.
3. Service Limitations
- The SMS, email, and push-notification services are provided as an additional facility for your convenience.
- These services may occasionally be subject to errors, omissions, or inaccuracies.
- If you notice any errors in the information provided through alerts, you must notify True Wave Marketing immediately. TWM will make efforts to rectify such errors promptly.
You agree not to hold True Wave Marketing liable for any losses, damages, or expenses (including legal costs) arising from:
- Non-availability of the SMS/email/push-notification services.
- Delays, distortions, or non-delivery of alerts due to factors such as infrastructure or connectivity issues with the service provider.
4. Indemnification
You agree to indemnify and hold harmless True Wave Marketing and its SMS/email service providers from any claims, damages, or expenses (including legal costs) arising from:
- Misuse of the communication service or providing false/fraudulent information.
- Providing an incorrect mobile number or email ID, or a number/email ID that belongs to an unrelated third party.
- Messages related to your membership, business updates, purchase confirmations, cancellations, rescheduling, or other service-related updates sent to incorrect or unrelated contacts due to your error.
5. Service Disclaimer
- The clarity, accuracy, and timeliness of alerts depend on multiple factors, including service provider infrastructure and connectivity.
- True Wave Marketing shall not be responsible for any distortion, delays, or errors in alerts caused by external factors beyond its control.
This Communication Policy is designed to ensure smooth and transparent communication between True Wave Marketing and its users. By registering with True Wave Marketing, you acknowledge and accept the conditions outlined above.

Use of True Wave Marketing (TWM) Platform
You understand and agree to the following:
- Information, Products, and Services:
- Except for the information, products, or services explicitly provided and indicated by True Wave Marketing (TWM), we do not operate, control, or endorse any information, products, or services available on the internet in any way.
- Third-Party Content:
- Any third-party information, products, or services accessed through the TWM Platform are the responsibility of the respective third parties.
- TWM does not endorse or guarantee the quality, accuracy, or reliability of such third-party content.
- Internet Security:
- True Wave Marketing does not guarantee or warrant that files available for download through the TWM Platform will be free from viruses, worms, malware, or other potentially harmful code.
- It is your responsibility to implement appropriate security measures to protect your devices and data, including up-to-date antivirus software and firewalls.
- Data Accuracy:
You are responsible for verifying the accuracy of data input and output while using the TWM Platform to meet your specific requirements.
- User Responsibilities:
- Take necessary precautions to ensure a secure internet experience.
- Regularly update your device's security settings to prevent unauthorized access or damage.
Prohibited Conduct – True Wave Marketing (TWM)
By accessing or using the True Wave Marketing Platform (TWM Platform) or by availing of TWM Services, you agree not to engage in any of the following prohibited activities:
1. Violation of Terms & Conditions (T&Cs):
You must not violate the T&Cs or any policies or agreements related to the TWM Platform.
2. Fraudulent Activities:
- Impersonate any person or entity.
- Falsely claim or misrepresent your affiliation with any person or entity.
- Access the accounts of others without permission.
- Forge another person’s digital signature.
- Misrepresent the source, identity, or content of information transmitted via TWM Services.
- Avail of TWM Services using potentially fraudulent funds or perform any other fraudulent activity.
3. Infringement of Rights:
- Infringe the intellectual property rights, publicity rights, or privacy rights of True Wave Marketing or any third party.
4. Age Restrictions:
- Use TWM Services if you are under 18 years of age without parental sponsorship.
- Use TWM Services if you are under 13 years old, even with parental sponsorship.
5. Offensive or Harmful Content:
- Post or transmit libelous, defamatory, vulgar, or offensive content.
- Disclose private or personal matters concerning any individual.
- Post pornographic or inappropriate material.
6. Interference and Misuse:
- Remove, disable, or damage any security features of the TWM Platform.
- Reverse engineer, decompile, or attempt to discover the source code of the TWM Platform.
- Overburden, disable, or impair the platform’s infrastructure or network.
- Intentionally upload or disseminate viruses, spyware, or other malicious software.
- Use bots, spiders, or other automated tools to monitor or copy the TWM Platform without prior written permission.
7. Manipulation and Exploitation:
- Forge headers or manipulate data to disguise the origin of content or your presence on the TWM Platform.
- Use the platform to collect personal or financial information about other users without their consent.
- Modify, adapt, or create derivative works of TWM Services without authorization.
8. Unauthorized Activities:
- Sell or misuse TWM Services, software, or information derived from the platform.
- Solicit or perform illegal activities or activities infringing on the rights of others using the TWM Platform.
9. Misleading Information:
- Provide false, inaccurate, or misleading information.
10. Abuse of Services:
- Use TWM Services in a manner that causes complaints, disputes, chargebacks, fees, fines, or penalties to True Wave Marketing or third parties.
- Abuse payment systems or violate payment network rules.
11. Disruption:
- Interfere with or disrupt the TWM Platform or connected networks.
- Take actions that impose an unreasonably large load on TWM’s infrastructure or network.
12. Unauthorized Requests:
- Send automated requests or perform automated actions on the TWM Platform without prior written permission from True Wave Marketing.
Consequences of Prohibited Conduct
Engaging in any of the above activities may result in:
- Suspension or Termination of your account.
- Legal action by True Wave Marketing or affected third parties.
- Fines, penalties, or liability for damages.

Termination; Agreement Violations – True Wave Marketing (TWM)
You agree that True Wave Marketing (TWM), at its sole discretion, may take the following actions without penalty and for any reason or no reason:
1. Suspension or Termination of Account
- TWM may suspend or terminate your account (or any part of it), including your Independent Business Owner (IBO) profile, at any time.
- This may include removing or discarding your account, user profile, or any associated data from the TWM Platform.
2. Discontinuation of Services
- TWM reserves the right to discontinue providing access to the TWM Services or any part of the platform at its discretion, with or without notice.
3. No Prior Notice
- You agree that termination of your access to the TWM Platform or any portion of your account may occur without prior notice.
- TWM will not be held liable to you or any third party for termination, suspension, or service interruptions.
4. Grounds for Termination
Termination may be initiated under the following circumstances:
- Suspected Fraudulent Activity: Any suspected fraudulent, abusive, or illegal actions may result in termination and referral to law enforcement authorities.
- Violation of T&Cs: Breaching any of the Terms and Conditions.
- Improper Use: Engaging in activities that harm the integrity of the platform or violate user agreements.
5. Legal and Equitable Remedies
- These termination rights are in addition to any legal or equitable remedies available to True Wave Marketing under applicable laws.
6. Post-Termination Obligations
Upon termination, you agree to:
- Immediately cease using the TWM Platform and its services.
- Ensure no further attempts to access your account or the TWM Platform.
Limitation of Liability and Damages – True Wave Marketing (TWM)
True Wave Marketing (TWM) and its contractors, agents, licensors, partners, or suppliers shall not be held liable to you for any special, indirect, incidental, consequential, punitive, or exemplary damages, including (but not limited to):
- Lost Business Opportunities
- Lost Revenues or Anticipated Profits
- Any Other Pecuniary or Non-Pecuniary Losses or Damages
These limitations apply regardless of the cause or circumstances, including but not limited to:
- (i) This Agreement.
- (ii) The IBO Agreement.
- (iii) The TWM Services or TWM Platform.
- (iv) Your use or inability to use the TWM Platform, its services, materials, or any associated sites/platforms/apps.
- (v) Any other interactions with True Wave Marketing.
Liability Cap
In no event shall True Wave Marketing, its directors, employees, or agents be liable for damages, losses, or causes of action exceeding the greater of:
- The amount you paid, if any, for the specific service or platform causing the claim.
- ₹5,000, whichever is less.
Fair Risk Allocation
You acknowledge and agree that:
- Warranty Disclaimers and Limitations of Liability are key to the business model of True Wave Marketing.
- These limitations represent a fair and reasonable allocation of risk between you and TWM.
- Without these limitations, TWM would not be able to provide services to you on an economically reasonable basis.
Applicable Law & Exceptions
Certain laws may not allow the complete limitation or exclusion of liability for incidental or consequential damages.
- In such cases, the liability of True Wave Marketing will be limited to the fullest extent permissible under applicable law.
Survival of Clause
This Limitation of Liability and Damages clause will survive the termination of this Agreement.
Indemnification – True Wave Marketing (TWM)
You agree to indemnify, save, and hold harmless True Wave Marketing (TWM), its affiliates, employees, officers, directors, and partners from any and all claims, losses, damages, liabilities, costs, and expenses (including legal fees and expenses) arising out of or related to:
- Your Use or Misuse of TWM Services or Platform:
- Any improper or unauthorized use of the True Wave Marketing Platform or its services.
- Violation of Agreements:
- Any violation of this Agreement or the IBO Agreement by you.
- Breach of Representations or Warranties:
- Any breach of the representations, warranties, or covenants made by you under this Agreement.
TWM’s Rights
- Exclusive Defence and Control:
- TWM reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify True Wave Marketing, including the right to settle claims.
- Cooperation Required:
- You agree to cooperate fully with TWM in the defence and settlement of these claims.
Notification of Claims
- TWM will make reasonable efforts to notify you of any claim, action, or proceeding brought by a third party that is subject to indemnification as soon as it becomes aware of it.
Survival of Indemnification Clause
This Indemnification Clause will survive the termination of this Agreement.
By using the TWM Platform or its services, you accept and agree to comply with the above indemnification terms.
Disclaimer; No Warranties – True Wave Marketing (TWM)
To the fullest extent permissible under applicable law, True Wave Marketing (TWM) and its affiliates disclaim all warranties or guarantees, whether statutory, express, or implied, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights.
No Additional Warranties
- No advice or information, whether oral or written, obtained by you from TWM or through the TWM Platform or services will create any warranty or guarantee beyond those expressly stated in this agreement.
For the purposes of this Disclaimer, the term "TWM" includes True Wave Marketing’s officers, directors, and employees.
Third-Party Services and Obligations
- True Wave Marketing is not liable for the obligations, rates, quality, or services of third parties (such as product suppliers, payment gateways, or other vendors).
- Use of third-party services accessed through the TWM Platform is at your sole risk.
Platform Use at Your Risk
You expressly agree that:
- Use of the TWM Platform and services is at your sole discretion and risk.
- It is your responsibility to evaluate the accuracy, completeness, and usefulness of opinions, advice, services, and other information provided via the platform or the internet in general.
No Guarantee of Uninterrupted Service
- TWM does not warrant that:
- Services will be uninterrupted or error-free.
- Defects or errors will be corrected.
- The platform, its data, third-party software, or services will be free of viruses, harmful components, or other errors.
"As Is" and "As Available" Basis
The TWM Services and platform are provided on an “as is,” “as available,” and “with all faults” basis without any warranties or representations of any kind, either express or implied.
No Representations of Accuracy or Reliability
- TWM and its partners do not warrant or guarantee the correctness, accuracy, or reliability of the platform, services, or any third-party references accessed through the platform.
Responsibility for Use
- You understand and agree that your use, access, or download of information, materials, or data through the TWM Platform is at your sole discretion and risk.
- You will be solely responsible for any damage to your property (including your computer, mobile device, or other equipment) or loss of data caused by such use or download.
No Authorization for Additional Warranties
- True Wave Marketing does not authorize any person or entity to make warranties on its behalf. Any such statements should not be relied upon by you.
Limitation of Liability
- In no event shall True Wave Marketing be liable for:
- Incidental, consequential, or indirect damages.
- Loss of profits, business interruption, or data loss arising out of your use of or inability to use the TWM Platform or services.
Survival of Disclaimer
This Disclaimer; No Warranties clause will survive the termination of this agreement.
By using the True Wave Marketing Platform, you acknowledge and agree to the above disclaimers and terms.
Ownership; Proprietary Rights – True Wave Marketing (TWM)
The True Wave Marketing Services and the TWM Platform are owned and operated by True Wave Marketing. All visual interfaces, graphics, design, compilation, information, computer code (including source code and object code), products, software, services, and all other elements provided through the TWM Platform (hereinafter referred to as Materials) are protected by applicable intellectual property laws, including but not limited to:
- Indian copyright laws.
- Trademark, trade dress, and patent laws.
- International conventions and other relevant proprietary rights laws.
Ownership of Materials
As between You and True Wave Marketing:
- All Materials, trademarks, service marks, and trade names contained on the TWM Platform are the sole property of True Wave Marketing.
- You may not remove, obscure, or alter TWM or any third party’s copyright, trademark, patent, or proprietary notices affixed to or contained within the TWM Platform or Services.
Restrictions on Use
Except as expressly authorized by True Wave Marketing, you agree NOT to:
- Sell, license, or distribute any of the Materials.
- Copy, modify, or publish the Materials.
- Create derivative works based on the Materials.
- Publicly perform or display the Materials.
- Transmit, edit, or adapt the Materials for unauthorized purposes.
TWM reserves all rights not expressly granted in this Agreement.
Suggestions and Feedback
If you provide feedback, comments, or suggestions for improving the TWM Platform or Services, you:
- Irrevocably assign to True Wave Marketing all rights, title, and interest in such feedback, including any intellectual property rights associated with it.
- Agree to execute any documents and perform any acts necessary to perfect these rights for True Wave Marketing.
Modification of this Agreement – True Wave Marketing (TWM)
True Wave Marketing (TWM) reserves the right to change, modify, add, or remove portions of this Agreement (each referred to as a change and collectively as changes) at any time. Such changes will be communicated to you through notifications on the TWM Platform or other appropriate communication channels.
Effective Date of Changes
- Notification and Acceptance:
- Changes will become effective 24 hours after the initial posting of the notification on the TWM Platform or after direct communication to you.
- Your continued use of the TWM Platform or services after this period signifies your acceptance of the changes.
- Immediate Application:
- The changes will apply immediately on a going-forward basis to:
- Your use of the TWM Platform.
- Availing of TWM Services.
- Payment transactions initiated after the posting date of the changes.
Your Rights
- If you do not agree with any changes made to this Agreement, your sole and exclusive remedy is to terminate your use of the TWM Platform and services.
Advance Notice for Certain Changes
- For changes requiring advance notice under applicable laws, True Wave Marketing will ensure compliance by providing you with prior notification within the legally required timeframe.
Acceptance of Changes
Your continued use of the True Wave Marketing Platform and services following the posting or communication of changes will mean that you accept and agree to the changes.
Notice – True Wave Marketing (TWM)
True Wave Marketing (TWM) may provide you with notices and communications through the following methods:
- Email: Notifications sent to your registered email address.
- SMS: Alerts sent to your registered mobile number.
- Push Notifications: Through the TWM app, if enabled.
- Regular Mail: Sent to your registered mailing address.
- Postings: Notices posted directly on the TWM Platform.
- Other Reasonable Means: Communication through any other appropriate method deemed reasonable by TWM.

Waiver – True Wave Marketing (TWM)
The failure of True Wave Marketing (TWM) to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision.
Conditions for Waiver
- Any waiver of a provision of this Agreement will be effective only if it is in writing and signed by an authorized representative of TWM.
- Verbal or implied waivers will not be considered valid or enforceable.
By using the TWM Platform and services, you acknowledge and agree to these waiver terms.
Dispute Resolution – True Wave Marketing (TWM)
If any dispute, controversy, or claim arises under this Agreement or in relation to any True Wave Marketing Service or the TWM Platform (hereinafter referred to as Dispute), including any question regarding the existence, validity, or termination of this Agreement or Terms and Conditions (T&Cs), the following process will apply:
1. Amicable Resolution
The parties shall make all reasonable efforts to resolve the Dispute amicably.
- If the Dispute cannot be resolved within 30 days of notice of such Dispute, further steps will be taken as outlined below.
2. Arbitration Process
True Wave Marketing may elect to resolve the Dispute through binding arbitration under the provisions of the Indian Arbitration and Conciliation Act, 1996 (hereinafter referred to as the Act).
- Individual Arbitration:
- The Dispute shall be arbitrated on an individual basis and cannot be consolidated with claims or controversies of any other party.
- Arbitrator:
- A sole arbitrator shall be appointed in accordance with the Act.
- Seat of Arbitration:
- The arbitration proceedings shall be conducted in Hyderabad, India.
- Language:
- The language of arbitration shall be English.
3. Interim Relief
Either party may seek interim or preliminary relief from a court of competent jurisdiction in Hyderabad to protect their rights or property (or the rights or property of agents, suppliers, or subcontractors) pending the completion of arbitration.
4. Confidentiality
All arbitration proceedings shall remain strictly confidential.
- Neither party may disclose the existence, content, or results of the arbitration, except as required by law or to enforce the arbitration award.
5. Fees and Expenses
- All administrative fees and expenses of the arbitration will be divided equally between the parties.
- Each party will bear the costs of their own legal representation and preparation.
6. Survival of Clause
This Dispute Resolution clause will survive the termination of this Agreement.
Governing Law and Forum for Disputes – True Wave Marketing (TWM)
Subject to the Dispute Resolution section outlined above, the following terms apply:
- Jurisdiction:
- You agree that any claim or dispute arising out of or related to True Wave Marketing (TWM) must be resolved by a court having jurisdiction in Hyderabad, India.
- You consent to submit to the personal jurisdiction of the courts located within Hyderabad, India, for the purpose of litigating such claims or disputes.
- Governing Law:
- This Agreement, along with the Terms and Conditions (T&Cs), shall be governed and construed in accordance with the laws of India.
- Survival of Clause:
- This clause shall survive the termination of this Agreement.
Severability – True Wave Marketing (TWM)
If any provision of this Agreement is deemed unlawful, void, invalid, or otherwise unenforceable, the following will apply:
- Limitation of the Invalid Provision:
- Such provision will be limited or eliminated to the minimum extent required to comply with applicable laws.
- Validity of Remaining Provisions:
- All other provisions of this Agreement shall remain valid, enforceable, and in full effect.
This clause ensures that the Agreement as a whole remains operational even if specific provisions are found to be unenforceable.
Survival – True Wave Marketing (TWM)
Upon the termination or expiration of this Agreement, the following terms will apply:
- Provisions That Survive:
- Any provision that, by its nature or express terms, is intended to survive termination will remain in effect.
- Applicability to Prior Relationships and Transfers:
- These surviving provisions will continue to apply to transfers, obligations, and relationships established prior to the termination or expiration of the Agreement.
Headings – True Wave Marketing (TWM)
The headings included in this Agreement and the Terms and Conditions (T&Cs) are provided solely for convenience and reference purposes.
- No Legal Effect:
- The headings do not constitute a part of the T&Cs.
- They will not be deemed to limit, define, or affect the interpretation or scope of any provisions in the Agreement.
This ensures clarity in understanding that the headings are purely organizational tools and hold no binding legal value.
Entire Agreement – True Wave Marketing (TWM)
This Agreement constitutes the entire agreement between You and True Wave Marketing (TWM) regarding the subject matter herein.
- Superseding Effect:
- This Agreement supersedes all prior agreements, understandings, or representations related to the subject matter.
- Modification:
- This Agreement may only be modified in accordance with the terms set forth by TWM.
- Changes or updates to the Agreement will follow the procedures outlined in the Modification of this Agreement section.
Eligibility – True Wave Marketing (TWM)
The True Wave Marketing (TWM) Platform and its services are subject to the following eligibility criteria:
- Age Requirement:
- TWM Services are not available to individuals under the age of 18 years.
- By accepting the T&Cs or using the TWM Platform, you represent that you are at least 18 years of age.
- Suspension or Removal History:
- The platform is not available to anyone previously suspended or removed by True Wave Marketing for any reason.
- Right and Authority:
- You represent and warrant that you have the right, authority, and capacity to enter into this Agreement and comply with the Terms and Conditions (T&Cs).
- Prohibition Against Misrepresentation:
- You must not:
- Impersonate any person or entity.
- Falsely state or misrepresent your identity, age, or affiliation with any individual or organization.
- Violation of T&Cs:
- In the event of any violation of the T&Cs, True Wave Marketing reserves the right to:
- Suspend your access temporarily.
- Permanently prevent you from using the TWM Platform or services.
By using the True Wave Marketing Platform, you acknowledge and confirm that you meet the above eligibility criteria.
Cancellation Policy – True Wave Marketing (TWM)
True Wave Marketing (TWM) strives to provide the best possible services. However, the following cancellation terms apply to tours, trips, and packages booked through TWM:
1. Cancellation Before the Tour/Trip Starts
- If a customer cancels their tour before the scheduled start date, a refund may be issued based on specific circumstances and company policies.
- Refund amounts and conditions will be determined solely by True Wave Marketing.
2. Cancellation During the Tour/Trip
- If a customer decides to cancel their tour midway, they may not be entitled to any refund.
- In exceptional circumstances, a partial refund may be offered, but this will be at the discretion of the company.
3. Delayed or Missed Flights, Trains, or Buses
- True Wave Marketing is not responsible for refunds or compensation if a customer:
- Misses their flight, train, or bus.
- Experiences delays due to circumstances beyond their control.
- The company is not liable to provide extensions, additional stays, or cancellations of the package due to such situations.
4. Cancellation Voucher Code
- Upon booking a tour package, customers will receive a voucher code valid for one year.
- In the event of a cancellation (under limited circumstances), the voucher code will be reactivated and can be used during the validity period.
Important Notes
- All refunds and cancellations will be subject to True Wave Marketing’s terms and conditions.
- Customers are advised to carefully review the cancellation policy before booking.
Refund Policy – True Wave Marketing (TWM)
True Wave Marketing (TWM) has a transparent refund policy to ensure clarity for its customers. Please review the terms below carefully:
1. Non-Refundable Fees
Certain fees are non-refundable, including but not limited to:
- Tour Package Fees:
- Once a tour package is confirmed, it becomes non-refundable.
- Any non-refundable fees will be clearly mentioned during the booking process.
- Third-Party Services:
- Costs for services provided by third parties (e.g., flights, insurance) are subject to the third-party's refund policies, not TWM’s.
2. Cancellation Procedure
- To request a cancellation, contact our customer service team at Twmarketing46@gmail.com.
- Provide the following details:
- Your booking reference number.
- Details of the tour package you wish to cancel.
- Important Note:
- Refunds are not available, but you can use your booking voucher to reschedule a tour within one year from the original booking date.
3. Tour Package Validity
- Each tour package you book is valid for one year from the initial booking date.
- After the one-year validity period, you will no longer be eligible to use the package or receive a refund.
4. Refund Processing Time
- Upon cancellation (under limited circumstances), the voucher code provided at the time of booking will be reactivated and made available for use again within the one-year validity period.
- Refunds in cash or monetary form are not applicable.
